DOE Won’t Increase Regulation on Gas to Boost Coal, Perry Says

The Trump administration wants to revitalize the coal industry, but they will not do so by imposing regulation on the natural gas industry, Secretary of Energy Rick Perry told reporters July 18 at a joint press conference with International Energy Agency Executive Director Fatih Birol.

“Would the Department of Energy (DOE) be a participant in putting regulations into place to protect a particular energy sector?,” Perry said. “The answer is no.”

Though he firmly stated that DOE will not increase regulation on energy sources that compete with coal, he was unclear about how the administration intends to make coal competitive again.

He seemed to suggest that exports, either of coal or technology, would play a large role in a revitalized coal industry.  Noting that coal still accounts for roughly 40% of worldwide energy generation, Perry stated: “It’s not like coal has been pushed out of the marketplace, I mean you are going to see coal used in the world. Our goal is for us to use the cleanest technology that we can and generally speaking, that technology is going to come from the U.S.”…

Experts: If Clean Power Plan Perishes, GHG Regulation Almost Certain Under NAAQS Program

If the Clean Power Plan is scrapped or weakened, the Environmental Protection Agency (EPA) may be forced to regulate greenhouse gases (GHGs) emitted by existing power plant with wider repercussions under its National Ambient Air Quality Standards (NAAQS) program, experts have warned.

While President-Elect Donald Trump promised to “scrap” the Clean Power Plan during his presidential campaign, the power sector has grappled with regulatory uncertainty since the Supreme Court issued a stay of the rule that establishes the first federal GHG limits for existing fossil fuel–fired power plants in February 2016. The rule, finalized in 2015 under Section 111 (d) of the Clean Air Act, has deeply divided the nation and U.S. power sector.

Eighteen states (plus the District of Columbia) supported the rule in the merits litigation: California, Connecticut, Delaware, District of Columbia, Hawaii, Illinois, Iowa, Maine, Maryland, Massachusetts, Minnesota, New Hampshire, New Mexico, New York, Oregon, Rhode Island, Virginia, Vermont, and Washington. A number of power companies are also participating as intervenors, including Calpine, Pacific Gas & Electric, NextEra, and Southern California Edison Co.…

AEP to Shed Ohio, Indiana Coal and Gas Plants in Move for Full Regulation

In an effort to become a fully regulated power company, American Electric Power (AEP) has agreed to sell four Midwestern power plants—representing a total of 5.2 GW—to a newly formed joint venture of Blackstone and ArcLight Capital Partners for about $ 2.17 billion. 

AEP will sell:

  • the 1,186-MW natural gas–fired Lawrenceburg Generating Station in Lawrenceburg, Ind.
  • the 840-MW natural gas–fired Waterford Energy Center in Waterford, Ohio
  • the 507-MW natural gas–fired Darby Generating Station in Mount Sterling, Ohio
  • the 2,665-MW coal-fired Gen. James M. Gavin Plant in Cheshire, Ohio

All generating capacity is located in the region served by PJM Interconnection.

The sale is expected to close in the first quarter of 2017, but it is subject to regulatory approvals from the Federal Energy Regulatory Commission (FERC), the Indiana Utility Regulatory Commission, and federal clearance pursuant to the Hart-Scott-Rodino Antitrust Improvements Act of 1976, AEP said.
