A sweeping new proposed rule published in the Federal Register by the Environmental Protection Agency (EPA) on April 6 establishes new nitrogen oxide (NOx) emissions budgets that will require fossil fuel–fired power plants in 25 states to participate in an allowance-based ozone season trading program starting in 2023.
The proposal, which builds on the agency’s existing Cross-State Air Pollution Rule (CSAPR), seeks to implement the EPA’s 2015 National Ambient Air Quality Standards (NAAQS) for ozone of 70 parts per billion by imposing federal implementation plans (FIPs) on these states using its authority under the “good neighbor” requirements of the Clean Air Act. States affected are: Alabama, Arkansas, Delaware, Illinois, Indiana, Kentucky, Louisiana, Maryland, Michigan, Minnesota, Mississippi, Missouri, Nevada, New Jersey, New York, Ohio, Oklahoma, Pennsylvania, Tennessee, Texas, Utah, Virginia, West Virginia, Wisconsin, and Wyoming.
The EPA’s existing CSAPR ozone-season NOx program limits NOx emissions from fossil fuel–fired electric generating units (EGUs) in 22 states during the ozone season, which runs from May 1 through September 30.…
A subsidiary of billionaire Warren Buffett’s Berkshire Hathaway Energy has announced it plans to invest another $ 3.9 billion into renewable energy in Iowa, with a project that would add more than 2 GW of wind power to the state.
Des Moines-based MidAmerican Energy on Jan. 19 said the Wind PRIME project also includes solar power generation, and exploration of what the utility called new technologies, which could include small modular nuclear reactors (SMRs). The company said the project will advance MidAmerican’s transition to net-zero greenhouse gas emissions. MidAmerican said construction of the project, after approval from state regulators, could begin as soon as 2024.
Kelcey Brown, CEO and president of MidAmerican, in a statement said, “As MidAmerican continues to progress toward delivering 100% renewable energy to our customers, we are also preparing to meet an important milestone of net-zero greenhouse gas emissions. The Wind PRIME project will position us and our customers for a sustainable future, while ensuring we continue to deliver affordable and reliable energy.”…
In a move widely applauded by the power industry, the Environmental Protection Agency (EPA) and Department of the Army proposed a new definition of “waters of the U.S.” (WOTUS) that could exempt groundwater and ditches from regulation under the Clean Water Act (CWA).
The measures follow other recent significant regulatory actions by the agency. On December 6, the agency also announced proposed revisions to performance standards governing carbon dioxide emissions from new, reconstructed, or modified coal-fired power plants. On November 15, the EPA clarified guidelines on when activities can be grouped together to determine whether they trigger New Source Review (NSR) permitting. And on November 7, it posted a final implementation rule for the 2015 ozone standard.
The revised definition for “WOTUS” proposed by the EPA and the Department of the Army on December 11 significantly narrows the number of waterways and wetlands that fall within the jurisdictional scope of the CWA compared to a contentious rule finalized by the Obama administration in June 2015.…
