Settlement Reached in Largest U.S. Coal Ash Cleanup

Duke Energy will save about $ 1.5 billion in coal ash cleanup costs under a settlement between the utility and environmental and other groups announced Jan. 2 by North Carolina’s Department of Environmental Quality (DEQ).

The DEQ said Duke Energy will need to excavate about 80 million tons of coal ash currently stored in basins at six of the utility’s power generation sites. The ash will be moved to lined landfills. The DEQ said it will be the largest cleanup of coal ash in U.S. history. The utility will be allowed to leave coal ash in place at some of its locations.

Duke Energy already is in the process of closing all its coal ash basins at plants in several states, including 31 in North Carolina. Utilities across the U.S. are spending billions of dollars cleaning up coal ash stored near power plants nationwide.…

Utility Reaches Settlement in Emissions Lawsuit

The Colorado Springs City Council, which also serves as the board for community-owned Colorado Springs Utilities (CSU), approved the settlement of a lawsuit brought against the city’s downtown coal-fired Martin Drake Power Plant, an agreement that in part promises CSU will look at options for 100% of its power to come from renewable sources as early as 2030.

The city council—in executive session and without a public vote—approved a $ 425,000 settlement with New Mexico-based environmental group WildEarth Guardians. The group had said thousands of violations of the federal Clean Air Act had occurred at Martin Drake. The settlement was filed April 17 in U.S. District Court in Denver, Colorado.

Amy Trinidad, a spokeswoman for the utility, told the Colorado Springs Gazette that CSU denied the allegations in the lawsuit but was still willing to reach a settlement. A bench trial on the suit was originally scheduled to begin in early April, but attorneys in the case informed the court negotiations were underway toward an out-of-court resolution.…

Regulators Back Settlement for Costs of Failed Kemper IGCC Project

Shareholders of Mississippi Power will have to absorb the majority of outstanding costs resulting from the scuttled Kemper County coal gasification project, as the state’s Public Service Commission (PSC) on February 6 approved a settlement for the remaining liabilities associated with the much-touted “clean coal” plant.

Mississippi Power in a statement said it “is pleased with this final order from the Public Service Commission, which effectively settles all costs associated with the Kemper County energy facility.” Anthony Wilson, the company’s CEO, in a statement after today’s vote said, “The economics really didn’t work out and the technology was hard to perfect.”

The PSC in 2017 told Atlanta-based Southern Co. to end construction at Kemper. The gasification project, touted as the future of coal, never was operational, as costs ballooned from an original price tag of $ 2.9 billion to about $ 7.5 billion. The settlement agreement, which was reached last year pending approval, means Mississippi Power, a subsidiary of Southern Co.,…
